1. Acceptance of Terms

By accessing and using NIGHTNOTES ("the App", "we", "us", or "our"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your access to and use of the NIGHTNOTES mobile application, including any content, functionality, and services offered on or through the App.

2. Description of Service

NIGHTNOTES is a mobile application that provides:

  • Dream journaling and recording capabilities
  • AI-powered dream analysis and interpretation
  • Personalized horoscope generation
  • Statistics and pattern analysis of your dreams
  • Educational articles about dreams and sleep
  • Cloud synchronization across devices
  • Premium subscription features

3. Use License

Permission is granted to download and use NIGHTNOTES for personal, non-commercial use only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the App or its content
  • Use the App for any commercial purpose or for any public display
  • Attempt to reverse engineer, decompile, or disassemble any software contained in the App
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the App to another person or "mirror" the App on any other server
  • Use the App in any way that violates applicable laws or regulations

This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time.

4. User Accounts and Data

4.1 Account Responsibility

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password.

You must immediately notify us of any unauthorized use of your account or any other breach of security.

4.2 User Content

You retain all rights to your dream journal data and content. We do not claim ownership of your content. However, by using the App, you grant us a limited, non-exclusive, royalty-free license to use, store, and process your data solely to provide and improve the service.

You are solely responsible for the content you create and store in the App. You agree not to use the App to:

  • Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, or violates any rights
  • Impersonate any person or entity
  • Upload content that contains viruses or malicious code

4.3 Data Backup

While we provide cloud synchronization, you are responsible for backing up your data. We are not liable for any loss of data due to technical failures, user error, or account deletion.

5. Premium Subscriptions

5.1 Subscription Plans

NIGHTNOTES offers premium subscription plans that provide access to additional features, including:

  • Unlimited AI dream analysis
  • Advanced statistics and insights
  • Unlimited audio recordings
  • Priority customer support
  • Additional themes and customization options
  • Data export features

5.2 Subscription Terms

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage your subscription and turn off auto-renewal by going to your account settings in the App Store (iOS) or Google Play Store (Android) after purchase.

Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

5.3 Refunds

Refunds are handled by Apple (for iOS) or Google (for Android) according to their respective refund policies. We do not process refunds directly.

If you cancel your subscription, you will continue to have access to premium features until the end of your current billing period.

6. Content Disclaimer

IMPORTANT: The content provided in this App, including but not limited to horoscopes, dream analysis, AI-generated insights, and advice, is for informational and entertainment purposes only. This content should not be considered professional, medical, financial, or psychological advice.

6.1 Not Professional Advice

NIGHTNOTES does not provide medical, financial, or therapeutic services. The horoscopes and astrological interpretations are based on traditional astrological practices and are not scientifically proven. Dream analysis and AI-generated content are interpretive in nature and should not be used as a substitute for professional counseling or medical treatment.

6.2 Health and Mental Health

If you are experiencing mental health issues, financial difficulties, or medical concerns, please consult with qualified professionals in those respective fields. Do not rely on the App's content for making important life decisions.

7. AI-Generated Content Disclosure

Some content in this App, including horoscopes, dream analyses, and personalized insights, is generated with the help of artificial intelligence (AI).

  • AI-generated content is interpretive and should not be considered factual or guaranteed accurate
  • AI-generated content is based on patterns, algorithms, and training data, and may contain errors or inaccuracies
  • NIGHTNOTES does not guarantee the accuracy, completeness, or reliability of AI-generated content
  • You use AI-generated content at your own discretion and risk

AI analysis is optional and requires your explicit consent. You can enable or disable AI data sharing in your App settings.

8. Intellectual Property

The App and its original content, features, and functionality are owned by NIGHTNOTES and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not use our trademarks, logos, or other proprietary information without our express written consent.

9. Prohibited Uses

You agree not to use the App:

  • In any way that violates any applicable law or regulation
  • To transmit any malicious code or viruses
  • To attempt to gain unauthorized access to the App or its related systems
  • To interfere with or disrupt the App or servers connected to the App
  • To use any automated system to access the App without permission
  • To collect or harvest any information from the App

10. Limitation of Liability

In no event shall NIGHTNOTES, its developers, or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App, even if we have been notified orally or in writing of the possibility of such damage.

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

11. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, secure, or error-free, or that defects will be corrected.

12. Indemnification

You agree to indemnify and hold harmless NIGHTNOTES, its developers, and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will cease immediately. You may delete your account at any time through the App settings.

14. Changes to Terms

NIGHTNOTES may revise these Terms of Service at any time without notice. By continuing to use the App after changes are made, you are agreeing to be bound by the then current version of these Terms.

We will notify you of any material changes to these Terms by posting the updated Terms in the App or on our website.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NIGHTNOTES operates, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the jurisdiction in which NIGHTNOTES operates.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and NIGHTNOTES regarding the use of the App and supersede all prior agreements and understandings.
